DAY1FATHER operates this website, store, recognition platform, and related information, content, features, frameworks, interactive experiences, tools, products, and services (collectively, the “Services”). DAY1FATHER is powered by  ⁠Shopify, which enables us to provide certain ecommerce and website services.

This Privacy Policy describes how we collect, use, process, and disclose personal information when you visit, access, or use the Services, make a purchase or other transaction, use available interactive features, or otherwise communicate with us.

If there is a conflict between our Terms of Service and this Privacy Policy concerning the collection, use, processing, or disclosure of personal information, this Privacy Policy controls with respect to that subject.

Please read this Privacy Policy carefully. By accessing or using the Services, you acknowledge that you have read and understand the practices described in this Privacy Policy.

Recognition and interactive experience information, but only as described in this Privacy Policy and based on the feature you choose to use. Certain DAY1FATHER recognition experiences may process selections, responses, recognition results, Carry Profile information, Carry History, Recognition Timeline information, or other self-reflection content locally on your device or within your browser.

SOURCES OF PERSONAL INFORMATION

We may collect personal information from the following sources:

Directly from you, including when you create or use an account, make a purchase, communicate with us, submit information, or otherwise provide information through the Services.

Automatically through the Services, including from your device, browser, cookies, and similar technologies when you access or use the Services.

From Shopify and service providers that enable technology, ecommerce, payment, analytics, security, communications, fulfillment, shipping, or other functions on our behalf.

From business, advertising, or other partners, as permitted by applicable law and based on the services and settings we use.

HOW WE USE PERSONAL INFORMATION

Depending on how you interact with DAY1FATHER and which Services you use, we may use personal information for the following purposes:

Provide, operate, tailor, and improve the Services. We may use personal information to provide the Services, perform our contract with you, process payments, fulfill orders, remember preferences, manage accounts, arrange shipping, facilitate returns or exchanges, provide interactive features, and improve the functionality and experience of the Services.

Provide recognition and interactive experiences. Where applicable, information may be processed to display recognition results, maintain a Recognition Record, preserve user-selected preferences, or support Recognition Engine™, Recognition Console™, Recognition Timeline™, Recognition Archive™, Recognition Wallet™, Recognition Library™, or related Recognition OS™ experiences.

Marketing and advertising. We may use personal information for marketing and promotional purposes, including sending marketing communications and displaying advertising, subject to applicable law and your available choices.

Security and fraud prevention. We may use personal information to authenticate accounts, protect transactions, detect, investigate, or respond to possible fraudulent, illegal, unsafe, or malicious activity, protect the Services, and maintain security.

Communicating with you. We may use personal information to provide customer support, respond to inquiries, provide Service-related communications, and maintain our business relationship with you.

RECOGNITION OS™, LOCAL DEVICE STORAGE, AND SELF-REFLECTION INFORMATION

DAY1FATHER is a recognition platform. Certain Recognition OS™ experiences are designed to operate privately on the device or browser you use.

Where a DAY1FATHER feature states that information is “saved on this device,” “private on this device,” or uses similar language, the feature may use browser-based local storage or similar device-side technology to preserve information for that experience.

Depending on the feature, locally stored information may include Recognition Engine™ selections or results, Carry Profile information, Today’s Carry entries, Carry History™, Recognition Timeline™ information, Recognition Record information, preferences, or other self-reflection content you choose to enter.

Information stored locally on your device is generally controlled through the browser or device you use. Clearing browser data, using private browsing modes, changing devices or browsers, or certain browser or device settings may remove, limit, or prevent access to locally stored information.

DAY1FATHER does not represent locally stored recognition information as a medical record, mental health record, patient record, or clinical record.

Unless a feature clearly tells you that information will be submitted, transmitted, synced, shared, or otherwise sent through the Services, locally processed recognition information is intended to remain within the applicable device or browser experience.

You should not enter emergency information, crisis information, medical records, Social Security numbers, payment card information, passwords, or other highly sensitive information into open-text recognition or self-reflection fields.

RECOGNITION, EDUCATIONAL, AND INFORMATIONAL EXPERIENCES

The Services may include recognition identities, recognition frameworks, questionnaires, prompts, interactive experiences, self-reflection tools, educational content, and related materials.

The Recognition Engine™, Recognition OS™, Recognition Console™, Recognition Timeline™, Recognition Wallet™, Recognition Archive™, Recognition Library™, Recognition Record, The Five Faces Of Carrying™, HPOS™, The Ones Who Carried™, And Still Carrying™, Present-Day Carry Patterns, and related DAY1FATHER experiences are provided for recognition, informational, educational, and self-reflection purposes.

These experiences are not medical, psychological, psychiatric, therapeutic, counseling, or diagnostic services.

DAY1FATHER does not provide medical or mental health diagnosis, treatment, therapy, or professional healthcare advice through the Services.

Recognition identities, results, profiles, descriptions, patterns, observations, prompts, or other outputs should not be interpreted as clinical classifications or statements about a person’s medical or mental health status.

The Five Faces™ are recognition identities, not diagnoses, personality types, or clinical categories. HPOS™ is a DAY1FATHER recognition framework and is not a medical or psychological diagnosis. Present-day carrying does not automatically indicate HPOS™ or a Five Faces™ identity.

HOW WE DISCLOSE PERSONAL INFORMATION

In certain circumstances, we may disclose personal information to third parties for legitimate business, operational, legal, or other purposes described in this Privacy Policy, subject to applicable law.

These circumstances may include:

Shopify, vendors, and service providers that perform services on our behalf or enable the Services, including ecommerce, website hosting, IT management, payment processing, analytics, communications, customer support, cloud services, fulfillment, and shipping.

Business and marketing partners that provide marketing, advertising, or related services. Depending on where you reside, you may have rights to opt out of certain uses of personal information for targeted advertising or activities defined as “sale” or “sharing” under applicable privacy law.

Third parties when you direct, request, or consent to disclosure, including when disclosure is necessary to ship a product, complete a transaction, or enable an integration you choose to use.

Affiliates or entities within our corporate group, if applicable.

RELATIONSHIP WITH SHOPIFY

The Services are hosted or enabled in part by Shopify. Shopify collects and processes personal information relating to access to and use of the Services in order to provide, secure, and improve its services.

Information submitted through Shopify-enabled portions of the Services may be transmitted to or processed by Shopify and applicable service providers, including in countries other than the country where you reside.

DAY1FATHER may use Shopify features that rely on information obtained from interactions with our store, Shopify, or other merchants. Where Shopify determines the purposes and means of processing for its own features or services, Shopify is responsible for that processing as described in its applicable privacy policies.

THIRD-PARTY WEBSITES, SERVICES, AND LINKS

The Services may provide links to websites, platforms, services, or functionality operated by third parties.

If you access a third-party service, you should review that provider’s privacy, security, and other applicable policies. DAY1FATHER does not control and is not responsible for the privacy or security practices of unaffiliated third parties.

Information you provide through public or semi-public third-party platforms, including social networking platforms, may be viewable or used by others in accordance with the applicable platform’s practices.

The inclusion of a third-party link or functionality does not, by itself, imply endorsement of that third party or its content.

COOKIES AND SIMILAR TECHNOLOGIES

The Services, Shopify, and applicable service providers may use cookies, pixels, local storage, and similar technologies to operate the Services, remember preferences, understand usage, provide security, support analytics, and, where permitted, provide or measure advertising.

Your available cookie and privacy choices may depend on your location and the settings made available through the Services, Shopify, your browser, or your device.

Where required by applicable law, we may provide cookie consent or privacy preference controls.

CHILDREN’S DATA

The Services are not directed to children, and we do not knowingly collect personal information from children under the age required by applicable law to consent to the relevant processing.

DAY1FATHER recognition experiences are not designed for a child to submit personal information, medical information, crisis information, or highly sensitive information without appropriate authorization.

If you are a parent or legal guardian and believe a child has provided personal information to us, contact us using the information below to request review or deletion, as applicable.

As of the effective date of this Privacy Policy, we do not have actual knowledge that we “sell” or “share,” as those terms are defined under applicable law, personal information of individuals under 16 years of age.

SECURITY AND RETENTION OF INFORMATION

No security measure or method of transmission is completely secure, and we cannot guarantee perfect security.

We recommend that you do not use unsecured channels or open-text recognition fields to communicate highly sensitive, confidential, medical, financial, authentication, or emergency information.

How long we retain personal information depends on factors including whether the information is needed to provide the Services, maintain an account, complete transactions, comply with legal obligations, resolve disputes, protect the Services, or enforce contracts and policies.

Information stored locally on your own device or browser through a local-storage feature may remain until it is deleted through the applicable feature, browser, or device controls, or until the browser or device otherwise removes it.

YOUR RIGHTS AND CHOICES

Depending on where you live, you may have some or all of the following rights regarding personal information. These rights are not absolute, may apply only in certain circumstances, and may be subject to legal exceptions.

Right to Access or Know. You may have the right to request access to personal information we maintain about you.

Right to Delete. You may have the right to request deletion of personal information we maintain about you.

Right to Correct. You may have the right to request correction of inaccurate personal information.

Right to Opt Out of Sale, Sharing, or Targeted Advertising. Depending on where you reside, you may have the right to opt out of activities defined as the sale or sharing of personal information or processing for targeted advertising.

Managing Communication Preferences. You may opt out of promotional emails by using the unsubscribe option in applicable emails. If you opt out of promotional communications, we may still send non-promotional communications relating to transactions, accounts, security, or the Services.

Where applicable, a Global Privacy Control opt-out preference signal may be treated as an opt-out request for the browser or device sending the signal, as required by applicable law and supported by the Services or Shopify.

Other “Do Not Track” signals may not be recognized unless required by applicable law.

We will not discriminate against you for exercising applicable privacy rights.

We may need to verify your identity before processing a request, as permitted or required by law. Where permitted, you may designate an authorized agent to submit a request on your behalf. We may require proof of authorization and may ask you to verify your identity directly.

We will respond to verified requests within the time required by applicable law.

COMPLAINTS AND APPEALS

Depending on where you live, you may have the right to appeal a decision relating to a privacy request or lodge a complaint with an applicable data protection or regulatory authority.

INTERNATIONAL TRANSFERS

Where applicable law requires a recognized transfer mechanism for personal information transferred from the European Economic Area, United Kingdom, or another jurisdiction, the applicable organization responsible for the transfer may rely on Standard Contractual Clauses, an adequacy decision, or another lawful transfer mechanism.

CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect changes to the Services, our practices, technology, legal requirements, or other operational reasons.

We will post the revised Privacy Policy through the Services, update the “Last updated” date, and provide additional notice where required by applicable law.

This is much closer to the Day1Father we built. The biggest privacy fix is the new “Recognition OS™, Local Device Storage, and Self-Reflection Information” section. Your old policy still talked like Day1Father was primarily a Shopify store and still referenced third-party assessment tools like Tally. Your Recognition Engine and Console now use device-side storage language, so the policy needed to reflect that.
